Tagline
Benefit of doubt—Delayed FIR, delayed postmortem, material contradictions, unexplained injuries on accused, conflict between ocular and medical evidence, unreliable site plan and defective forensic evidence entitle accused to acquittal.
Summary
The appellants were convicted by the trial court for the murder of Saif-ul-Malook and causing firearm injuries to several injured witnesses. They challenged their convictions before the Lahore High Court.
After examining the entire record, the High Court found numerous serious defects in the prosecution case. The FIR was lodged after an unexplained delay of seven hours despite the police station being only 11 kilometers away. The postmortem was also conducted after considerable delay, and police papers appeared to have been prepared even before registration of the FIR, creating suspicion of consultation and fabrication.
