Summary
The petitioners, officials of the Accountant General Khyber Pakhtunkhwa, challenged a letter issued by the Controller General of Accounts (CGA) seeking information regarding officers allegedly involved in payments from security deposits to contractors following a fact-finding inquiry (FFI). They argued that the FFIs were flawed, relied solely on SAP-generated data, ignored physical records and subsequent audit findings, and were intended to initiate unlawful disciplinary proceedings.
The High Court dismissed the petition, holding that the impugned letter was merely an administrative request for information and did not amount to initiation of disciplinary proceedings. No charge sheet had been issued, no inquiry under the Efficiency & Discipline Rules had commenced, and no adverse order affecting the petitioners' rights had been passed.
The Court emphasized that constitutional jurisdiction under Article 199 cannot be invoked against preliminary inquiries, fact-finding exercises, or requests for information unless they are patently without jurisdiction, mala fide, or produce immediate civil consequences. The petition was held to be premature and barred by the doctrine of ripeness because no enforceable legal injury had yet occurred.
