Summary
The petitioner challenged the judgments of the Family Court and the Revisional Court, which had upheld the setting aside of a compromise entered into during execution proceedings relating to dower, maintenance, and possession of property.
Originally, the respondents obtained a family court decree granting possession of property, dower, and maintenance for minor children. During execution proceedings, the parties entered into a compromise whereby Rs.250,000 and 4 marlas of land were agreed to be given in settlement of dower and maintenance claims.
Subsequently, the minors, through their mother, filed a review petition which was accepted. The petitioner challenged the review order through an application under Section 12(2) CPC, alleging fraud and concealment, but failed to prove those allegations.
