Summary: The petitioners, former contract employees of the Safe Mother Home Project, sought regularization of their services under the Sindh (Regularization of Adhoc and Contract Employees) Act, 2013. They challenged the order dated 05.06.2024 through which their regularization was refused on the ground that they were initially appointed by the Federal Government and later devolved to Sindh after the 18th Amendment. The petitioners argued that they had served continuously for more than a decade, fulfilled the requirements of Section 3 of the 2013 Act, and could not be denied benefits due to missing departmental records or administrative lapses. The respondents opposed, arguing that the Act applied only to provincial employees and that the petitioners’ original federal appointments lacked complete recruitment records. The Court held that after devolution, the petitioners became part of provincial service and were covered by the Sindh Regularization Act, 2013. The denial of regularization was declared arbitrary, discriminatory, and unlawful. The impugned order was set aside, and the petitioners were held entitled to regularization with consequential benefits.
