Summary The petitioner filed a constitutional petition under Article 199 challenging the inclusion of his name on the Exit Control List (ECL) through a memorandum dated 23.06.2023. He contended that although he had been acquitted in all criminal cases against him, his name remained on the ECL without any lawful justification, violating his constitutional rights. The Federal Investigation Agency (FIA) informed the Court that it had already recommended removal of the petitioner's name from the ECL. The Court held that, following the petitioner's acquittal and the FIA's recommendations, there was no legal basis for continuing the travel restriction. Finding the impugned memorandum arbitrary and unsupported by any speaking order, the Court set it aside and directed the competent authority to immediately remove the petitioner's name from the ECL and grant all consequential relief.
