Summary The petitioners, retired employees of the Custom House Common Pool Trust, filed a constitutional petition under Article 199 seeking payment of their pensionary benefits and other retirement dues, which had not been released after their retirement upon attaining the age of superannuation. During the proceedings, it was noted that one petitioner had passed away, and his legal heirs were granted time to be substituted. The respondents informed the Court that the matter was already pending before the Authority under the Payment of Wages Act, South Division Karachi. With the consent of the parties, the Court disposed of the petition and directed the Authority under the Payment of Wages Act to decide the petitioners' claims on merits within three weeks. Learned counsel for the petitioners submitted that petitioner are lower-grade retired employees who were appointed to various posts by respondent No. 3, namely the Custom House Common Pool Trust. Appointment letters, employment cards, and experience certificates were duly issued to them. Upon attaining the age of superannuation (60 years), the petitioners retired through formal office orders after rendering long and continuous service. However, despite their entitlement, the respondents failed to release their pensionary benefits and other legal dues at the time of retirement.
