The respondents contended that a corruption inquiry involving alleged financial irregularities and losses of approximately Rs.430 million justified withholding the retirement notification. The Court held that retirement occurs automatically upon attaining the age of superannuation and that a pending inquiry, without concluded disciplinary proceedings or a finding of guilt, cannot justify withholding retirement or pensionary benefits. It directed the respondents to issue the retirement notification and finalize all pension and retirement benefits in accordance with law.
