Section: 199

Summary The petitioner, a retired Medical Officer, sought retrospective actualization of her promotion from BPS-18 to BPS-19 effective from the Departmental Promotion Committee (DPC) recommendation dated 08.11.2012, along with revised pension and retiral benefits. She argued that although she was formally promoted in 2017, she never received the financial benefits of BPS-19 before retiring in 2018, unlike similarly placed officers. The respondents conceded that her case required consideration by the competent authority. The Court held that service benefits cannot be denied merely because an employee retires before administrative formalities are completed and directed the competent authority to actualize her promotion from the DPC date, subject to no legal impediment, and recalculate and release all consequential retiral benefits.
