Summary: The petitioner, a senior citizen and registered consumer of Karachi Water & Sewerage Board (KW&SB), filed a constitutional petition seeking restoration of regular potable water supply to his residence in Warsia Colony, Orangi Town, Karachi. He claimed that despite paying water charges, he had been deprived of proper water supply for more than 20 years due to damaged and outdated pipelines, forcing him to spend approximately Rs. 1.5 million on private water purchases. KW&SB admitted that the transmission line was old and damaged, causing low pressure and intermittent supply, but cited financial and infrastructure limitations. The Court held that access to clean drinking water is part of the fundamental right to life and dignity under Article 9 of the Constitution. It found KW&SB legally obligated under the Sindh Water & Sewerage Board Act, 1996, to provide adequate water supply and maintain infrastructure. The petition was allowed, directing KW&SB to rehabilitate pipelines and provide a weekly 1,000-gallon water tanker until regular supply is restored.
