National Cement Employees Cooperative Housing Society)

Law: Constitution of Pakistan, 1973

Section: 199,25

Summary The petitioner, an old member of a cooperative housing society, sought enforcement of an Award directing implementation of his residential plot allotment, restoration of allegedly illegally converted residential plots, and issuance of an execution certificate and NOC for possession. The Society argued that implementation was impossible due to non-availability of land following approval of the revised layout plan. The Court held that the Award remained valid and binding as it had never been set aside, and that the Society could not rely on its own administrative lapses or mismanagement to defeat the petitioner's vested rights. The Court directed the competent authority to execute the Award in accordance with law and ensure enforcement of the petitioner's allotment without discrimination.
