Summary These connected constitutional petitions concerned alleged illegal encroachments, commercialization of green belts, obstruction of service roads and the Right of Way (ROW) along the M-9 Motorway, unauthorized construction on public land, and interference with private property without lawful acquisition. The Court held that while the National Highway Authority (NHA) has statutory authority to develop ancillary facilities within the lawfully acquired ROW, it cannot utilize private land without acquisition or encroach upon public green belts, service roads, or drains in violation of law. The Court directed joint demarcation of disputed land, removal of unlawful encroachments, restoration of drainage infrastructure, compliance with environmental laws, maintenance of status quo regarding disputed private land, and monitoring of compliance by the Implementation Committee.
