Case Summary

The petitioner sought constitutional relief under Article 199 of the Constitution against the order of the Ex-Officio Justice of Peace, who had refused to direct the SHO to register an FIR under Section 154 Cr.P.C. regarding alleged offences committed by officials of the Punjab Enforcement and Regulatory Authority (PERA).

The High Court held that the alleged offences fell within the scope of the Punjab Enforcement and Regulation Act, 2024, which is a special law providing a complete statutory mechanism for addressing complaints against PERA officials. The Act contains specific provisions for filing representations, complaints, and registration of cases through designated authorities. Therefore, the general provisions relating to FIR registration under Section 154 Cr.P.C. were not applicable.

The Court found that the Ex-Officio Justice of Peace rightly declined to direct registration of an FIR because the petitioner had an effective alternative remedy under the special statute. Accordingly, the petition was disposed of with a direction to the petitioner to pursue the remedies available under the Punjab Enforcement and Regulation Act, 2024.
