Case Summary

The petitioner, M/s Cleanol Services, challenged the order of the Managing Director, Punjab Procurement Regulatory Authority (PPRA), whereby its bid for the janitorial services contract at Jinnah Hospital, Lahore was declared financially non-responsive for failing to separately include PESSI and EOBI contributions for reliever staff in its financial bid.

The Court held that although statutory contributions were not separately reflected, the petitioner had already disclosed the reliever staff in its bid and submitted a written affidavit undertaking to bear all PESSI, EOBI, income tax and other statutory deductions within the quoted bid amount, without seeking any increase in price. This amounted to a permissible clarification under Rule 33(2) of the Punjab Procurement Rules, 2014, not an impermissible alteration of the bid.

The Court ruled that the PPRA wrongly treated the procuring agency's later recalculation as reconstruction of the bid and ignored the petitioner's undertaking as well as the Grievance Redressal Committee's findings. Since the omission did not alter the quoted price, confer an unfair advantage, or prejudice competing bidders, declaring the bid financially non-responsive was unlawful.
