 Summary

The petitioner challenged the appellate judgment whereby the finding of the trial Court recognizing his alleged claim of Rs. 2,33,00,000/- as debt recoverable from the deceased's estate was reversed. He also claimed that, being the son of a predeceased brother, he was entitled to inherit the estate of the deceased and that the succession proceedings were incompetent because other legal heirs had not been impleaded.

The High Court held that under Sunni Hanafi Law, a full brother of the deceased excludes the son of a predeceased full brother (nephew) from inheritance under the doctrine that the nearer residuary excludes the more remote (Asabah). Since the respondent was the deceased's surviving full brother, the petitioner had no inheritance rights.

The Court further held that proceedings under the Succession Act, 1925 are summary in nature and are confined only to the issuance of a succession certificate for realization of the deceased's debts and securities. Such proceedings cannot adjudicate disputed debts, liabilities, title, ownership, or inheritance rights. Any alleged debt against the deceased must first be established through an independent civil suit before a competent court.
