VS

THE STATE (Respondent)

Law: Criminal Procedure Code (V of 1898)

Section: 342 ,29, 31,161, 173,101,103,

SUMMARY The appellant was tried for possession of alleged narcotic substance (Ice) recovered from a coach driver during a stop at Mochko Check Post. Prosecution produced four witnesses: the complainant (SIP Muhammad Yaseen), mashir HC Kashif Ali, investigating officer SIP Muhammad Mumtaz, and Head Moharrir Shahbaz Ahmed Khan. The prosecution relied on memo of arrest and recovery, FIR, site inspection memo, entries showing receipt and custody of the alleged drug, and the Chemical Examiner’s report. The appellant denied recovery in his 342 Cr.P.C. statement, claimed he was arrested from a coach carrying many passengers, and did not give evidence in his defence. (Sections 161, 173 regarding statements and challan procedures; Section 342 for recording accused’s statement). Given the defects in production and inspection of the vehicle and gaps in documentary chain, the appellate court acquitted the appellant.     - 2. memo of arrest and recovery, prepared in presence of mashirs HC Kashif Ali and PC Nisar Ahmed; for that he was booked in the FIR.   On conclusion of usual investigation, police submitted the challan against the appellant. After completing the codal formalities, the Trial Court framed the charge…
