Summary The applicant sought post-arrest bail in a murder case, arguing that he was falsely implicated after the FIR was lodged against unknown persons, that the identification parade was defective, and that no weapon or motive linked him to the offence. The prosecution opposed bail, relying on the eyewitness identification and investigation material connecting the applicant to the murder. The High Court held that the offence falls within the prohibitory clause of Section 497 Cr.P.C., found sufficient tentative evidence against the applicant, ruled that disputed evidence must be assessed during trial, and dismissed the bail application while directing the trial court to conclude the trial within three months. Upon reaching there, the complainant came to know that his son Muhammad Faizan aged about 28 years had been murdered by unknown persons at Eid Gah Football Ground near Korangi, Karachi. The complainant suspected involvement of one Tahir Baglol, a close friend of the deceased who used to spend considerable time with him and had remained with him a day prior to the occurrence, and further alleged that the murder had been committed either by the said person or by unknown culprits through firearm injury.
