Law: Constitution of Pakistan, 1973

Section: 199

Summary These connected constitutional petitions under Article 199 of the Constitution of Pakistan, 1973 challenge the legality of elections held in a Cooperative Housing Societies Union. The Petitioners allege that the election process was unlawful due to: incomplete and unauthenticated nomination scrutiny, rejection of nominations on irrelevant grounds, lack of proper quorum, violation of earlier court orders (30.09.2025 and 10.12.2025), and actions of the Receiver/Nazir beyond lawful mandate. They argue the entire election process and notification dated 27–29.12.2025 are void ab initio, arbitrary, and in violation of statutory rules and judicial directions. The Respondents contend that: elections were conducted by the Nazir as directed by a superior court, nomination scrutiny was properly completed, quorum was satisfied, and the petitions are not maintainable because related contempt proceedings are already pending before the Federal Constitutional Court. The Court held that since contempt proceedings regarding the same election and compliance issues are already pending before the superior court, parallel adjudication would violate judicial propriety and may create conflicting decisions. Therefore, the petitions were disposed of without deciding merits, with liberty to approach later after the contempt decision.
