IN THE HIGH COURT OF SINDH, KARACHI Present: Case Summary The petitioner sought registration of Methyl Bromide 99% pesticide under the Agriculture Pesticides Ordinance, 1971. Despite submitting complete documents, lab reports, and favorable recommendations from inquiry committees and APTAC sub-committees, the registration was repeatedly deferred without clear reasons. The respondents argued that the application was incomplete, trial data was defective, and statutory requirements under the Ordinance were not fulfilled. The Court held that although it cannot directly order registration, the authorities showed inordinate delay and administrative inaction. Since the application had remained pending since 2022 beyond the statutory period, the Court found it necessary to ensure lawful and timely decision-making. The petition was allowed in terms of mandamus, directing the authorities to decide the application within 45 days through a speaking order after due process. 📚 Sections / Laws Used Article 199 (Constitution of Pakistan, 1973) Article 4 (Right to be dealt with in accordance with law) Article 18 (Freedom of trade, business) Sections 4, 5, 12 — Agriculture Pesticides Ordinance, 1971 Rule 4 & Rule 5 — Agriculture Pesticides Rules, 1973 🧾 2 Two-Word Case Descriptions Administrative Delay Pesticide Registration ORDER Through instant petition, the petitioner claims following relief(s):- “(a) Declare that the failure by the Respondents to process the application of the Petitioner in respect of the registration of the product ie, Methyl Bromide 99% (the "Product") in accordance with the provisions of the Agriculture Pesticides Ordinance, 1971 and the Agriculture Pesticides Rules, 1973 is illegal, unlawful and unconstitutional, Direct the Respondents to forthwith complete the application process in respect of the registration of the Product in accordance with the applicable law, Grant any further relief that this Hon'ble Court…
