📌 Summary of Case The petitioners were appointed as Data Processing Assistants (BS-14) under the LARMIS project through a transparent recruitment process (advertisement, IBA Sukkur test, and interviews). They worked continuously on contract since 2014. Their similarly situated colleagues had already secured regularization through a court judgment (2023 PLC (CS) 447), which was upheld by the Supreme Court and implemented by the government. The petitioners sought the same treatment. The Court held that the petitioners were identically placed to the already regularized employees and denying them the same benefit would amount to discrimination. The respondents were directed to regularize their services from the date of initial appointment, release salaries and benefits, and not subject them to any fresh selection process. 📌 Sections / Articles Used Article 199 Constitution of Pakistan, 1973 Article 25 Constitution of Pakistan, 1973 Article 27 Constitution of Pakistan, 1973 2023 PLC (CS) 447 (Regularization precedent) 1996 SCMR 1185 2009 SCMR 1 📌 2-WORD CASE DESCRIPTION Service Regularization Equal Treatment O R D E R The petitioners have filed the captioned Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, with the following prayer: - That this Hon’ble Court would be pleased to declare that in the light of dicta laid down by this Court in the case colleagues of the petitioners reported in 2023 PLC (CS) 447, The appointments of the present petitioners are at par similar to their colleagues who were petitioners in the abovementioned reported judgment under Article 25 of the Constitution, and further direct the Respondent’s department to treat the petitioners as a regular employee form the date of their initial appointment against the post of DATA Processing Assistant; That this Hon’ble Court would be pleased to declare that the case of the petitioners is similar to their colleagues who were petitioners reported in 2023 PLC (CS) 447, and as such, similar treatment may kindly be given in the light of judgments reported in 1996 SCMR 1185 and 2009 SCMR 1. …
