Law: Criminal Procedure Code (V of 1898)
Section: 497(2)
Law: Control of Narcotic Substances Act (XXV of 1997)
Section: 9(1), (6)(c)
(a) Criminal Procedure Code ( V of 1898 ) S. 497(2)---Control of Narcotic Substances Act (XXV of 1997), S.9(1) Sr. No. (6)(c)---Possession of narcotic substances (heroin) weighing 1100-grams---Post-arrest bail , grant of--- Further inquiry---Sample sent for chemical analysis not found to be heroin---Record (including statement(s) of law /Police officer) revealed that the sample taken out from alleged recovery (heroin) was sent for chemical analysis, but the same had not been found as heroin as per report of Punjab Forensic Science Agency, Lahore ---Therefore, the case of prosecution against the petitioner required further probe/inquiry within the purview of subsection 2 of S.497 Cr.P.C. and it had become a case for grant of post arrest bail ---Bail was granted to petitioner / accused, in circumstances. (b) Control of Narcotic Substances Act (XXV of 1997) S.9---Possession of heroin---Chemical formula, structure and other characteristics of recovered substance---The chemical formula of Heroin is C21 H23 NO5, its molecular weight is 369.417 g/mol., it is chemical name is diacetylmorphine and its also known as diamorphine---Heroin does not have a single "Chemical Code", rather it is identified by several standardized chemical codes and names---The technical, scientific/systematic name as per International Union of Pure and Applied Chemistry (IUPAC) for Heroin is (5a, 6a) -7, 8-didehydro-4,5-epoxy-17-methylmorphinan-3,6 diol-diacetate; it is a semi-synthetic opioid;it is manufactured from morphine, a natural substance extracted from the seed pod of the opium poppy--- When heroin enters the body it is quickly metabolized into other compounds; it is first broken down into 6-monoacetylmorphine (6 MAM) and then further into morphine which then binds to opioid receptors in the brain ---Substance usually may be organic or inorganic; laboratory analysis can determine that it is organic or inorganic substance and furthermore can also see its chemical composition--- Now question does arise that if substance sent in the present case to Punjab Forensic Science Agency, Lahore was not found as heroin then what was it?; what was its chemical composition/formula,…
