📌 SUMMARY OF CASE This is a criminal appeal against conviction under Sections 376 PPC (rape) and 377 PPC (unnatural offence) arising from FIR No.130/2023. The complainant alleged that the appellant induced her into travelling to Karachi on a promise of marriage, kept her confined for about 11–12 days, and repeatedly subjected her to rape and unnatural sexual acts. Medical evidence, DNA report, and witness testimony supported the prosecution case. The defence argued consent and contradictions, claiming false implication due to refusal to marry complainant’s sister. The Court held that the victim’s testimony was consistent and corroborated by medical, forensic, and circumstantial evidence. It further held that consent obtained through promise of marriage amounts to manipulated consent and does not negate rape. The allegation of unnatural offence under Section 377 PPC was also proved. Consequently, the appeal was dismissed and conviction maintained. 📌 SECTIONS USED (NUMBERS ONLY) 376, 377, 342, 382-B 📌 2-WORD CASE DESCRIPTION Sexual Exploitation JUDGMENT SHEET Appellant having been convicted and sentenced u/s 376,377 PPC to suffer RI for 10 years and fine of Rs.50,000/-, in default to suffer SI for three months and to suffer RI for 03 years and fine of Rs.50,000/-, in default to suffer SI for three months respectively, ordered to run concurrently with benefit u/s 382-B Cr.P.C. in S.C.
