Section: 199
Case Summary This case is a constitutional petition under Article 199 of the Constitution of Pakistan, 1973 filed by the legal heirs of a deceased Pakistan Railways employee seeking release of outstanding financial dues amounting to Rs. 6.2 million. The employee died in service, and although some benefits (group insurance and gratuity) were paid, the remaining dues (including lump sum and plot-related payments) were withheld due to non-availability of funds and pending approval under the Prime Minister’s Assistance Package. The Court held that: Direct payment could not be ordered in constitutional jurisdiction because entitlement depends on sanction of funds and administrative determination. However, the claim could not be ignored due to administrative delay. The competent authority was directed to decide the claim within 60 days by passing a reasoned order and release payment if the petitioners are found entitled, without discrimination. The petition was disposed of with directions for expedited administrative decision-making.
