Section: 121(5)

Summary The petitioner, a Municipal Commissioner appointed through a competitive process, challenged his transfer order dated 20.11.2025, claiming it was premature, frequent, malafide, and contrary to Section 121(5) of the Sindh Local Government Act, 2013. He argued that after being reinstated through court orders following an unlawful termination, he was subjected to repeated transfers and replaced by a junior officer without any public exigency. The respondent town council passed Resolution No. 110 dated 02.12.2025, recommending that the petitioner continue as Municipal Commissioner because of his competence, familiarity with the area, and involvement in ongoing public projects. The Court observed that the council's recommendation supported the petitioner's retention and indicated that the transfer did not appear to be in the public interest. Consequently, the Government was directed to reconsider the transfer and issue a speaking order within two weeks, while the impugned transfer order was suspended until such decision. The petition was disposed of accordingly.
