Prior Acquittal Restores Presumption of Innocence: Past Criminal Cases Culminating in Acquittal Cannot Solely Disqualify an Applicant from Public Employment.

 Summary

The petitioner applied for the post of Sanitary Worker (BPS-01) within the Sindh Police Department. After participating in the recruitment process, he was issued a conditional offer of appointment subject to medical fitness, character verification, and clearance of criminal antecedents. Although the petitioner successfully submitted his medical and character clearances, his candidature was ultimately rejected by the Sindh Police Recruitment Board.

The sole ground for the rejection of his appointment was his past involvement in two criminal cases (FIR Nos. 171/2014 and 173/2014). However, the petitioner had been fully acquitted in both cases by a competent court of law before the recruitment process even commenced, with the trial court noting a complete lack of incriminating evidence.
