Law: Constitution of Pakistan, 1973
Section: 199
Tagline
Dismissal of a constitutional petition seeking retrospective promotion post-retirement due to failure to meet eligibility criteria, unexpunged adverse Performance Evaluation Reports (PERs), non-completion of mandatory training, and unreasonable delay (laches).
Summary
The petitioner, Nooruddin Abro, an employee of the Employees’ Old-Age Benefits Institution (EOBI), filed a Constitution Petition under Article 199 of the Constitution of Pakistan, 1973. He sought retrospective promotion from the post of Assistant Director (BPS-17) to Deputy Director (BPS-18) with effect from January 24, 2014, along with consequential monetary and pensionary benefits.
The petitioner's promotion had been deferred by the Departmental Promotion Committee (DPC) on January 24, 2014, due to the non-availability of his Performance Evaluation Reports (PERs) for multiple years and an adverse remark in his PER for 2012–2013, which characterized him as "not yet fit for promotion." The petitioner retired from service on May 8, 2017, and subsequently pursued departmental appeals, which were rejected.
