Summary
The petitioner filed a writ petition in the nature of Habeas Corpus, alleging that on December 31, 2025, officials from the Islamabad and Punjab Police conducted a joint raid at his office and forcibly abducted Malik Qamar Abbas (the detenue), keeping him in illegal and unlawful confinement.
The petitioner's counsel contended that after the filing of the petition, the police, acting in a malafide manner, officially registered the detenue's arrest on January 5, 2026, in connection with Crime No. 01/2026. Following this, the detenue was produced before a Magistrate and subsequently released on a surety bond of Rs. 50,000/-.
The respondents submitted a report demonstrating that the detenue had surfaced, was formally arrested under the designated criminal case, released on bail, and was physically present before the Court. Consequently, they argued the petition had served its purpose and was now infructuous.
