(a) Industrial dispute -Practice - Court recording evidence, hearing arguments and announcing order on same day-Contention Traps that by doing so Court did not grant full opportunity-No suggestion of prejudice in disposing of matter in one day-Award, in circumstances, held, not bad merely for reason of case being disposed of in one day. (b) West Pakistan Industrial Disputes Ordinance (lip of 1968), S. 8(S)-Member's absence-Order of Court not vitiated because of absence of Member representing employees on date, of hearing. (c) Industrial Court - Domestic enquiry - Evidence Corroboration of-No hard and fast rule as to when prosecution evidence should or should not be believed without corroboration . Prosecution evidence supported by material on record, held, rightly believed without corroborative evidence -of persons stated to have seen the occurrence. Date of hearing: 2nd July 1970. ORDER This is an appeal against an Order of the learned Chairman of the 1st West Pakistan Industrial Court, Karachi, dated the 5th of February 1970. The impugned order was passed on an application under section 38 of the West Pakistan Industrial Disputes Ordinance, 1968 (hereinafter called the repealed Ordinance). The facts giving rise. to the appeal briefly. Put are these. 2. The appellant was a Conductor. His bus was checked on 12th June 1969. The Checking Party found that 35 persons were travelling without tickets, although the appellant had realized fare from then. He was charge-sheeted. The Enquiry Officer found him' to be guilty of the charge. As a result of the enquiry, the District Manager, Government Transport Service, Hyderabad dismissed him, on 6th October 1969. The appellant presented an application on 10th November 1969. The Court examined the appellant, on the one hand, and Mr. Syed Ahmad Rizvi, Station Superintendent, for the Government Transport Service.…
