Summary The appellants sued in civil court seeking declaration and permanent injunction after alleging respondents and revenue officials fraudulently mutated their property. The Trial Court dismissed the suit, the Appellate Court reversed, and the High Court in revision restored the Trial Court’s dismissal relying on the revenue proceedings bar. The Supreme Court held the suit was not barred by section 172 of the West Pakistan Land Revenue Act, 1967 because questions of title and alleged fraud fall within civil court jurisdiction under section 9 CPC; it set aside the High Court order, reinstated the civil suit as pending, and directed the trial court to hear and decide the matter expeditiously. Core points Appellants claim ownership by registered sale deed and allege respondents obtained mutation by fraud and with revenue officials’ connivance. Appellants previously challenged the mutation before the revenue hierarchy; that forum’s powers are limited to record corrections and do not finally determine title or resolve fraud. Trial Court dismissed the civil suit; Appellate Court set that aside; High Court, on revision, restored the dismissal invoking the revenue bar. Supreme Court held section 172 (Act of 1967) does not bar civil courts from deciding questions of title or alleged fraud in mutation records. Civil courts retain jurisdiction under section 9 CPC to adjudicate fundamental ownership and fraud allegations; their determinations bind revenue authorities. The Supreme Court allowed the appeal, set aside the High Court order dated 23.12.2022, and remanded the suit to the civil court for expeditious trial without unnecessary adjournments.
