Judge Family Court & another.
Law: West Pakistan Family Courts Act, 1964
Section: 14, 14(3)
Summary:
The petitioners (wife and three minor children) challenged the Family Court’s judgment dated 24.01.2026, whereby their suit for maintenance (Rs. 20,000 per month per person with 10% annual increase) was dismissed due to failure to produce evidence. They sought constitutional relief for setting aside the judgment and an opportunity to lead evidence.
The High Court held that although the petitioners argued that closure of evidence was an interlocutory order not appealable under Section 14(3) of the West Pakistan Family Courts Act, 1964, the court found that the interlocutory order had merged into the final judgment and decree of dismissal. Since a final appealable decree existed, the proper remedy was to file an appeal before the Appellate Court under Section 14 of the Act.
