SUMMARY
The petitioner (Pak Qatar Family Takaful Limited) refused to pay a life Takaful claim of Rs. 38.5 million after the insured’s death, alleging:
- concealment of health condition
- non-disclosure of material facts
- alleged drug addiction
- delayed intimation of death
The Federal Insurance Ombudsman ordered payment of the claim with damages, finding the refusal unjustified. The Islamabad High Court upheld this decision. The Supreme Court (leave petition stage) agreed and dismissed the petition, holding that:
👉 The claim was valid
👉 Allegations of concealment were unproven
👉 Nominee’s right was established under the policy
👉 Rejection was without lawful basis
