ORD ✅ Summary The petitioner, residing in Dubai, sought protective (transitory) bail, unblocking of his CNIC, and renewal of his passport to return to Pakistan and surrender before the trial court in a customs-related FIR. He was declared an absconder due to non-appearance and his CNIC was blocked. He claimed no involvement in the alleged offence and expressed willingness to face trial. The respondents opposed the petition, arguing that an absconder is not entitled to bail. The Court held: Under constitutional jurisdiction, fundamental rights like fair trial and personal liberty must be protected. Granting transitory bail allows the accused to appear before the trial court without undue hardship. The Court granted: Protective bail for two weeks Subject to surety of Rs. 500,000 Directed authorities to facilitate travel (CNIC/passport) Petition disposed accordingly. âš–ï¸ Sections / Laws Used Article 199, Constitution of Pakistan Sections 16, 32, 79, 192, Customs Act, 1969 Section 156(1) clauses 1, 9, 14, 86, Customs Act, 1969 Import and Export Control Act, 1950 Import Policy Order, 2020 🧾 Two 2-Word Case Descriptions Protective Bail Customs Offence ER SHEET This petition under Article 199 of the Constitution Islamic Republic of Pakistan, 1973, has been filed by the Petitioner/Muhammad Hashim, who has sought the following reliefs: To grant two months protective bail to the petitioner, namely Muhammad Hashim S/o Habibi Ur Rehman in FIR No.02/2022/File No.SI/Misc/30-2022-VII under section 16, 32, 79 & 192 of the Customs Act, 1969 R/w Import and Export Control Act, 1950 punishable under clause 1, 9, 14 & 86 of Section 156 (1) of the Customs Act, 1969 R/w Import Policy Order 2020 registered at Office of the Collectorate of Customs Appraisement (West), Custom House, Karachi.
