Law: Income Tax Ordinance, 2001
Section: 214D, 214D(1) 119(3), 119(4), 177
🔹 Core Issue Whether Section 214-D of the Income Tax Ordinance, 2001 applies when: Taxpayer files an extension request under Section 119, but Commissioner does not pass any written order. 🔹 Key Facts Petitioners: Filed extension applications before due date. No approval/rejection was issued by Commissioner. Filed returns within requested extended time. FBR: Treated returns as late. Issued audit notices under Section 214-D + 177. 🔹 Petitioners’ Argument Commissioner failed statutory duty (no written order under Section 119). Taxpayers should not suffer due to department’s inaction. Returns filed within requested time → 214-D should not apply. 🔹 Respondents’ Argument No written approval = extension deemed rejected. Returns filed after due date → automatic audit valid. Extension beyond 15 days was not justified. 🔹 Court’s Key Findings Section 119 requires a written order (mandatory). If no order is passed: Application is treated as pending, not rejected. No “deemed rejection” concept exists in law. Taxpayer lost right to approach higher authority due to department’s inaction. 🔹 Reliance on Supreme Court Case CIR v. Atta Cables (Pvt.) Ltd. Section 214-D must be strictly applied. No audit unless extension application is decided in writing. No implied or deemed refusal allowed. 🔹 Final Decision Section 214-D not applicable. Audit notices declared illegal. All proceedings set aside. 🔹 Key Legal Principle 👉 Without a written order on extension request, taxpayer cannot be penalized for late filing under Section 214-D. ORDER; INAAM AMEEN MINHAS, J:- This judgment shall decide the afore-titled writ petitions as they raise common question of law pertaining to the applicability of Section 214-D of the Income Tax Ordinance, 2001 (“ITO, 2001”), where an application for extension of time under Section 119(3) of the ITO, 2001, has been filed before the Commissioner. The petitioners have challenged the notices and subsequent notices issued under Section 214-D read with Section 177 of the ITO, 2001 (“Impugned Notices”) and all the proceedings initiated…
