Law: West Pakistan Civil Services Pension Rules, 1963

Section: Rule 2.3(i)

Law: Civil Service Regulations, 1960

Section: 371-A

Summary: The petitioners, initially appointed as contractual Medical Officers and later regularized under the Sindh Regularization of Doctor’s Appointed on Contract Basis Act, 2003, sought inclusion of their contractual service period in the calculation of their pensions. Relying on Supreme Court precedents (e.g., Chairman/Dean Sheikh Zayed Hospital v. Amjad Mehmood Khan, 2025 SCMR 168; Shah Jehan Shah, PLD 2016 SC 534; Syed Afroz Akhtar Rizvi, 2021 SCMR 1546), the Court recognized that temporary/contractual service can be counted for pension purposes if followed by uninterrupted regularization. The Court held that petitioners, having completed the qualifying service period as regular employees, are entitled to have their contractual service included in pension computation and directed the respondents to recalculate and settle their pension dues without delay. Sections/Rules Used: Sindh Regularization of Doctor’s Appointed on Contract Basis Act, 2003 – Regularization of contractual doctors. West Pakistan Civil Services Pension Rules, Rule 2.3(i) – Temporary/contractual service counting for pension. Civil Service Regulations, Article 371-A – Inclusion of temporary/officiating service in pension calculation. 2 Two-Word Descriptions: Pension Calculation Contractual Inclusion   ORDER  The Petitioners were appointed as Medical Officers on a contractual basis by the Health Department, Government of Sindh in the year 1996, with their services subsequently being regularized under the Sindh Regularization of Doctor’s Appointed on Contract Basis Act, 2003, with effect from 20.12.2003, after which they remained in service until their respective dates of retirement, completing the ten (10) year period of regular service over and above the time served under contract so as to qualify for pension. They seek that such period for which they served under contract be included for purpose of calculation of their pensions.   As things stand, a similar matter was addressed in the Judgment rendered by the Honourable Supreme Court of Pakistan in the case reported as Chairman/Dean Sheikh Zayed Hospital, Lahore v. Amjad Mehmood Khan…
