Section: 16-A
Summary
The petitioners challenged the eviction order passed by the Rent Controller and upheld by the Appellate Court under the Islamabad Rent Restriction Ordinance, 2001. The tenancy agreement was valid until February 2026, but the petitioners admittedly defaulted in payment of rent from May to July 2025.
The petitioners argued that the arrears were later paid in lump sum and that mediation could be pursued. The High Court held that subsequent payment of arrears does not cure admitted default, especially when there are concurrent findings of fact by the lower courts.
Finding the petition frivolous and devoid of any legal question, the Court dismissed it in limine and imposed costs of Rs.10,000, directing that the amount be paid to the Edhi Foundation.
