Summary: The petitioners, retired officers of National Insurance Company Limited (NICL), filed a petition under Article 199 seeking implementation of an 18.50% pay and pension increase from 01.01.2015, which had been granted to unionized staff but denied to regular officers, causing financial disparity. The petitioners relied on Section 4 of the Insurance Ordinance, 2000 and Regulation 16(3)(iv) of the Pension Regulations, 1986, which mandate pension indexation in line with Federal Government policy. Despite committee recommendations and Board resolutions, NICL had withheld the increase, leading to claims of discrimination under Articles 4 and 27 of the Constitution. The Court disposed of the petition by directing NICL to decide the matter lawfully within three weeks.
