Law: Sindh (Regularization of Ad hoc and Contract, Employees) Act, 2013

Section: 3,4

Summary The petitioners, employees of the Board of Revenue, Sindh working on the Automation of Stamps & Registration project, sought directions for regularization of their services, payment of salaries since July 2023, and grant of all consequential benefits. They had initially been appointed on a contractual basis, but under the Sindh (Regularization of Adhoc & Contract Employees) Act, 2013, they became eligible for regularization. Despite earlier Court orders in CP No.D-1820/2015 and 1415/2015 directing their cases to be considered, the respondents delayed creating sanctioned posts, denied salaries, and treated the petitioners in a discriminatory manner. The Court observed that the petitioners had worked for over 12 years, were eligible for regularization under Section 3 of the Regularization Act, 2013, and denial of benefits violated their fundamental rights under the Constitution. The Court allowed the petition, directing respondents to issue regularization orders and pay arrears of salaries within 60 days, while dismissing CMA No. 21367/2025 filed by interveners.
