Summary
The appellant filed an Execution First Appeal (EFA) challenging the dismissal of her objections under Order XXI Rule 103 of the Code of Civil Procedure, 1908, along with a Civil Revision, both arising from disputes over ownership of property belonging to deceased Malik Atta Ullah.
The appellant claimed ½ share of the property as dower (Haq-Mehr) recorded in the Nikah Nama dated 17.11.1974, whereas the respondent claimed ownership of the entire property based on a decree for specific performance dated 21.09.1985 obtained through an agreement to sell with Malik Atta Ullah.
The courts below dismissed the appellant’s objections mainly on the grounds that she had not produced the original Nikah Nama and had not recorded her dower in official records, and also held the objections to be barred by limitation.
