Summary
The petitioner, Muhammad Arshad, sought pre-arrest bail in FIR No.463 dated 08-12-2025 registered at Takhat Mahal Police Station under Sections 10(1), 36(1)(b) and 39 of the Punjab Fertilizers Control Act, 2025.
The prosecution alleged that during inspection of the petitioner’s shop “Messrs Al-Noor Spray and Seed Centre”, a fertilizer sample taken from a sealed bag was declared adulterated by the laboratory.
During the hearing, the Court questioned the Agriculture Department and police regarding the involvement of the manufacturer or supplier of the fertilizer. The officials admitted that the Standard Operating Procedures (SOPs) and provisions of the Act were not properly implemented and that investigation was limited only to the shopkeeper.
