Summary

The petitioner filed a civil revision challenging the judgments of the Civil Judge 1st Class, Gujranwala (12.06.2025) and Additional District Judge, Gujranwala (05.01.2026) whereby his suit for declaration and cancellation of registered sale deed No.6721 dated 04.07.2013 was dismissed after acceptance of an application under Section 11 of the Code of Civil Procedure, 1908 (CPC).

The respondents contended that the matter had already been adjudicated in earlier consolidated suits concerning the same property and the same sale deed, decided through judgment dated 06.05.2024, in which respondent No.1 was declared lawful owner of the property.

The High Court held that the present suit was an attempt to re-litigate the same matter already finally decided between the parties, therefore it was barred by the doctrine of res judicata under Section 11 CPC.
