 Abbasi Shaheed Hospital & others)

Law: Constitution of Pakistan, 1973

Section: 199,25

Summary

House Job Doctors of Abbasi Shaheed Hospital filed a constitutional petition seeking payment of withheld stipends and Health Risk Allowance, claiming parity with doctors in other Sindh hospitals. They argued violation of contractual promises, government notifications, and Article 25 (equality) of the Constitution. The respondents objected on grounds of master–servant relationship, disputed entitlement to allowances, and factual controversies.

The Court held that the petition was maintainable under Article 199, as enforcement of government policies and equal treatment were involved. While the Court did not grant direct monetary relief, it directed the competent authority to examine eligibility of the petitioners for Health Risk / Special Health Care Allowance under applicable policies and to pass a reasoned order after hearing within three months. The petition was disposed of accordingly.
