Law: Constitution of Pakistan, 1973

Section: 199

Summary:
The petitioners, Assistant Directors (Technical) holding B.Tech (Hons) degrees at the Sindh Building Control Authority (SBCA), challenged the SBCA (Recruitment) Regulations, 2016 and office orders denying them promotion and seniority. They alleged discrimination in promotion ratios, unlawful exclusion from DPC consideration, and violation of service and constitutional rights. The Court held that the Regulations are non-discriminatory, that B.Tech and BE/B.Arch degrees are distinct qualifications regulated by different statutory bodies, and that promotions must strictly follow the prescribed recruitment rules and quotas. In view of binding Supreme Court precedents, the Court declined to interfere and dismissed the petition.
