 Summary

The petitioner challenged concurrent judgments whereby his suit for recovery of outstanding rent was dismissed for want of evidence under Order XVII Rule 3 CPC. The High Court held that despite repeated opportunities and issuance of statutory notices, the petitioner failed to produce any evidence. Invocation of penal provisions was therefore justified. No illegality, misreading, or non-reading of evidence was found in the concurrent findings of the courts below, warranting interference in revisional jurisdiction. Consequently, the civil revision petition was dismissed.
