 Summary

The petitioner challenged the appellate order passed by the Secretary, School Education Department, Punjab, whereby his appeal against the penalty of removal from service under the Punjab Employees Efficiency, Discipline and Accountability (PEEDA) Act, 2006 was rejected. The High Court held that the disciplinary proceedings were vitiated due to vague and general charges, denial of procedural safeguards, non-speaking appellate order, and gross disproportionality of punishment. It was further held that once disciplinary action is taken under a statute like the PEEDA Act, constitutional jurisdiction under Article 199 is clearly attracted irrespective of the nature of underlying service regulations. The impugned orders were set aside and the petitioner was restored to service with all consequential benefits.

Tag Line

Removal from service set aside where charges were vague, inquiry violated due process, punishment was disproportionate, and appellate order was non-speaking—proceedings under PEEDA Act held justiciable under Article 199.
