Law: Constitution of Pakistan, 1973

Section: 199

Law: Sindh Rented Premises Ordinance, 1979

Section: 18

Law: Muhammadan Law

Section: 152(2)

Summary:

The petitioner, Muhammad Afzal, challenged the appellate court’s order in a rent matter regarding Bungalow No. 265, Haroon Bungalows, Karachi. He claimed there was no landlord-tenant relationship, alleging that he received possession from Chaudhry Nazeer Ahmed in connection with a sale, and disputed the validity of a gift deed transferring ownership from Zahora Bibi (respondent No.1) to Zahid Nazeer (respondent No.2). The appellate court affirmed the existence of a landlord-tenant relationship under Section 18 of the Sindh Rented Premises Ordinance, 1979 and relevant principles of Muhammadan Law regarding gifts. The petitioner’s arguments on ownership/title were held irrelevant to tenancy proceedings. The High Court dismissed the constitutional petition, holding that no jurisdictional error, manifest illegality, or procedural irregularity was shown to justify interference under Article 199 of the Constitution.
