Law: Constitution of Pakistan, 1973

Section: 199

Law: Karachi Port Trust Act, 1886

Section: 87

Summary:

The petitioner, an Assistant Manager (HR) at Karachi Port Trust (KPT), challenged a show-cause notice issued against him, claiming it was malicious, illegal, and violated rules. He alleged discrimination in pay scale (appointed BPS-16 instead of BPS-17), requested restoration of accommodation, promotion consideration, and protection from negative action. The petitioner argued that the internal inquiry largely cleared him, but KPT still issued a show-cause notice threatening major penalties. KPT defended the notice, citing misconduct, unsatisfactory replies, and procedural compliance. The High Court held that a constitutional petition under Article 199 cannot be used to bypass statutory disciplinary channels and that the show-cause notice alone does not amount to illegality or jurisdictional defect. The petition was dismissed as misconceived and not maintainable.
