Summary:
Moosa and Shan (alias Bablo) were convicted for the murder of Iqbal Shah. Moosa was originally sentenced to death under Section 302(b) PPC, and Shan to life imprisonment, both with fines as compensation to the legal heirs. The High Court reviewed the case for confirmation of the death sentence. Evidence proved both appellants’ presence at the scene, with Moosa firing the shots. Considering lack of proven motive and slight doubts, the court reduced Moosa’s sentence from death to life imprisonment while maintaining Shan’s sentence. Other fines and penalties remained intact. Both appellants were granted the benefit of section 382(b) Cr.P.C.
