Const. P. 2052/2007 (D.B.)
MUHAMMAD KARIM KHAN AGHA J.
3.4.2009. Mr. Muhammad Nawaz Shaikh, Advocate for the Petitioners. Mr. Miran Muhammad Shah, AAG Sindh.
Nabi Bakhsh Junejo V/S Province of Sindh and others Sindh High Court, Karachi
Law: Constitution of Pakistan, 1973
Section: 4,25
Summary:
The petitioners were Diploma holders working as Water Management Officers in BPS-16 in the Sindh Agriculture Department. The Finance Department issued an order promoting only graduate officers to BPS-17, excluding diploma holders. The petitioners claimed this was discriminatory since they performed the same duties and some had more seniority. The Agriculture Department recommended treating diploma and graduate officers equally, but the Finance Ministry rejected it, citing differences in educational qualifications. The court examined Articles 4 and 25 of the Constitution (right to equality and protection of law) and concluded that the classification based on educational qualifications was reasonable and not discriminatory. The petition was dismissed.
