Section: 497
Law: Pakistan Penal Code, 1860
Section: 396,397
Summary:
This is a second bail application arising from a dacoity-cum-murder case. Although the offences were of a serious and capital nature, the accused had remained in custody for about six years and the trial was not concluded despite High Court directions. The delay was not attributable to the accused. Considering the constitutional right to an expeditious trial and settled case-law on hardship, bail was granted due to inordinate delay.
