Section: 25
Summary:
The petitioners, Additional Prosecutor Generals (APGs) of Sindh, sought enhancement of their non-practicing allowance to match that of lawyers in the Advocate General’s office, arguing that paying them less was discriminatory. The Court analyzed differences in appointment, tenure, pay structure, job security, and pension rights. APGs are civil servants with secure jobs, pensions, and annual increments, whereas Advocate General lawyers serve at pleasure, have no pension, and less job security. The Court held that while APGs receive lower non-practicing allowances, this is balanced by their other benefits. Therefore, there is no unconstitutional discrimination, but recommended the Government of Sindh consider increasing APG allowances to reduce disparity.
