Case Summary
The petitioner sought a direction for immediate unblocking of his CNIC, which had been blocked on the request of Askari Bank during execution proceedings under Section 19(1) of the Financial Institutions (Recovery of Finances) Ordinance, 2001. He claimed that the blocking order was passed without notice and expressed willingness to settle the decretal amount out of court.
The Court observed that the CNIC was blocked pursuant to an order passed by the Banking Court No. II, Karachi, under execution proceedings, and that the petitioner had an adequate alternate remedy available before the same Banking Court. Since the impugned action originated from a competent forum, the constitutional jurisdiction could not be invoked directly. The petition was therefore dismissed as misconceived, with liberty granted to the petitioner to approach the Banking Court for appropriate relief.
